SURS Annuitant Verification Form(for all new employees)

The Illinois General Assembly enacted a "Return to Work" law, 40 ILCS 5/15-139.5, effective August 1, 2013, requiring state universities and community colleges to ascertain the retirement status of current and prospective employees as related to coverage by the State Universities Retirement System (SURS). As a result of this law, any college or university that employs certain "affected annuitants" is required to make contributions to SURS on the affected annuitant's behalf.

As a condition of IVCC employment, you must verify that you are NOT an affected annuitant and must provide sufficient information to confirm that you ARE NOT an affected annuitant NOR WILL BECOME one as a result of your IVCC employment.

As a condition of IVCC employment, you also will be required to reimburse IVCC for any employer contribution IVCC is required to make as a result of your employment should you in fact be or become an affected annuitant.

Please answer the following questions. This form and information requested must be completed and returned to Human Resources before you can become hired.

A person receiving a retirement annuity from the System becomes an "affected annuitant" on the first day of the academic year following the academic year in which the annuitant first meets both of the following conditions:

(1) While receiving a retirement annuity under this Article, the annuitant has been employed on or after August 1, 2013 by one or more employers under this Article for a total of more than 18 paid weeks (which need not have been with the same employer or in the same academic year); except that any periods of employment for which the annuitant was compensated solely from federal, corporate, foundation, or trust funds or grants of State funds that identify the principal investigator by name are excluded.

(2) While receiving a retirement annuity under this Article, the annuitant was employed on or after August 1, 2013 by one or more employers under this Article and received or became entitled to receive during an academic year compensation for that employment in excess of 30% of his or her highest annual earnings prior to retirement; except that compensation paid from federal, corporate, foundation, or trust funds or grants of State funds that identify the principal investigator by name are excluded.

A SURS annuitant is someone that is retired and receiving money/pension from the State Universities Retirement System.

I understand that false answers, statements or omissions of any information requested here shall be sufficient grounds for disqualification from employment or immediate termination of employment.

I give IVCC permission to investigate my SURS annuitant status, including earnings and employment status at other SURS covered employers. If I accept additional employment with another SURS covered employer, I will notify IVCC's HR department within 10 days of accepting the new employment.

I have carefully reviewed this application form and certify that the facts set forth in the employment application are accurate and complete. I understand that if the College employs me, any misrepresentation on this application will be sufficient cause for the termination of employment and/or immediate cancellation of any contract executed between the applicant and Illinois Valley Community College. I understand, however, that the College is not obligated to provide employment and that I am not obligated to accept employment. Nothing in this application is intended to create any contract of employment or to create any rights in the nature of a contract of employment and I understand my employment with the College would be at will. I, the undersigned, hereby duly authorize IVCC officials to investigate all statements in this application and included in my resume (vitae), and I authorize IVCC officials to communicate with persons listed as references, former employers, and any others with whom you desire to check. I agree to hold such persons harmless with respect to any information they may give about me. I waive any right I may have to notice from any individuals and organizations named or referred to in this application prior to the release of any employment information to the College.
